These Terms and Conditions ("Terms") govern your access to and use of the Emin — Habit Tracker application (the "App"). Please read them carefully.
1 Agreement to Terms
By downloading, installing, or otherwise using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, you should not download or use the App.
2 License to Use
Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, and revocable license to install and use the App on devices that you own or control, solely for your own personal habit-tracking purposes.
This license does not permit you to sublicense, resell, rent, lease, distribute, or otherwise make the App available to any third party, nor to modify, reverse-engineer, or create derivative works from the App except to the extent expressly permitted by applicable law.
3 User Responsibilities
Because Emin is offline-first and stores all data exclusively on your device, you are solely responsible for maintaining your own backups. The App includes a built-in export tool that allows you to save your habit data to a file of your choosing; we strongly recommend using it regularly.
If you delete the App, lose your device, or otherwise lose access to its local storage without having created an export, your habit logs, streaks, and history cannot be recovered by us. We do not retain any copy of your data on any server.
You are also responsible for ensuring that your use of the App complies with all applicable laws and for keeping your device reasonably secure against unauthorized access.
4 Intellectual Property
The App, including its name "Emin — Habit Tracker," its visual design, layout, graphics, icon, source code, and all associated branding elements, is owned by us or our licensors and is protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership rights to you.
You may not copy, reproduce, distribute, or create derivative works based on the App's name, icon, design, or code without our prior written consent, except to the extent such use is permitted by applicable law.
5 Disclaimer of Warranties
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of defects.
We make no representation or warranty that tracking habits, viewing statistics, or using any feature of the App will result in improved health, behavior, productivity, or any other outcome. Results from habit tracking depend entirely on your own actions. We are not responsible for any technical malfunctions, data loss, missed reminders, device incompatibilities, or other issues arising from your use of the App.
6 Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall we, our developers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or in connection with your use of, or inability to use, the App, even if we have been advised of the possibility of such damages.
Where applicable law does not allow the exclusion or limitation of certain damages, our liability will be limited to the greatest extent permitted by that law.
7 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer is established, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the competent courts of that jurisdiction, except where mandatory local consumer-protection law provides otherwise.
